General Terms and Conditions for the use of ‚AdvoFinder’ – online matchmaking service

1. Scope of the Terms

The following Terms govern all legal relationships between AdvoFinder and the users of the online matchmaking service AdvoFinder.

If you don’t agree to these Terms you may not use the online matchmaking service. By using the service you are agreeing to be bound by these Terms.

2. Free of charge service

The use of the online matchmaking service AdvoFinder is free of charge to persons seeking an attorney.

3. Scope of services and service provision

The online matchmaking service AdvoFinder provides a technical tool for persons seeking an attorney and members of the Zurich Bar Association to get in contact with each other. AdvoFinder is the provider of this tool but does not involve itself in the agreements between attorneys and clients. Any form of use of the service is not intended to and will not create an attorney-client relationship between any person or entity and the Zurich Bar Association.

The service is intended for matchmaking purposes only and does not constitute legal advice. Any form of use of the service or any electronic communication sent via AdvoFinder will not create an attorney-client relationship.

The online matchmaking service AdvoFinder, the contents of the website, as well as the software with its documentation are protected by copyright. Any use exceeding the use described by these Terms requires the explicit written consent of the copyright owner.

AdvoFinder reserves the right to alter the online matchmaking service at any time in order to ensure a quality service.

No warranty is given that the online matchmaking service is error-free or will be available without interruption, or at all. AdvoFinder reserves the right to interrupt the service operations for necessary maintenance work.

Only sincere requests will be forwarded. Prosecution of misuse of the service remains reserved.

4. Contents on AdvoFinder

A user, when accessing or using the online matchmaking service, may not post or send any information or material which might be legally actionable, or any libellous, defamatory, obscene, derogatory, menacing, offensive, or indecent material.

AdvoFinder accepts no liability for any information or material published by a member of the Zurich Bar Association via the online matchmaking service AdvoFinder.

By activating hyperlinks on AdvoFinder you will leave the AdvoFinder website and reach external third-party websites. AdvoFinder accepts no liability for any information, products, services other material published on or offered by these sites.

5. Protection of data privacy

AdvoFinder adheres to the rules of data protection laws. All information collected on the occasion of the use of the online matchmaking service will solely be used for the purpose of service provision unless permitted by explicit consent of the user or required by the law.

The user is aware that the system uses “cookies” in order to ensure the full functionality of the online matchmaking service. The user accepts the storing of “cookies”.

6. Exclusions of liability

AdvoFinder accepts no liability whatsoever for any loss or damage incurred by the use of the online matchmaking service AdvoFinder unless the damage has been caused by its gross negligence or intent.

Subject to this, AdvoFinder is particularly not liable for any of the following:

– Loss or damage arising as a result of an interruption of the service operations or Internet connection;

– Loss or damage arising as a result of errors or failures of external third-party systems or third-party data centers which the online matchmaking service uses or to which he establishes a connection;

– Loss, destruction or corruption of data and/or information;

– Loss or damage arising as a result of software failures, hacker attacks, or other problems caused via the Internet;

– Any indirect, or consequential loss or damage, loss of profits, loss of business, loss of goodwill or reputation, arising as a result of the use of the online matchmaking service AdvoFinder.

AdvoFinder is not liable for any loss or damage caused by its auxiliary persons.

7. Miscellaneous

These General Terms and Conditions and all legal relationships between AdvoFinder and the users of the online matchmaking service shall be governed by the laws of Switzerland. You agree to submit to the jurisdiction of the courts of Zurich 1.

If any part of any of these Terms and Conditions is invalid or unenforceable, each provision which is invalid or unenforceable shall be replaced with a provision as similar in terms to such invalid or unenforceable provision as may be possible which is legal and enforceable.

If any part of any of these Terms and Conditions is invalid or unenforceable, it will not affect any other provision and all other provisions will remain in full force and effect.
